5. Unwarranted GPS
July 01, 2009

The New York State Court of Appeals overturned decisions on the Scott Weaver case based on evidence obtained by using a GPS device without a warrant on Weaver’s vehicle. The unit was in place for 65 days, during which Weaver allegedly committed two acts of burglary. Although the conviction did not at all hinge on the information gained by the tracking device, Weaver will receive a new trial with the GPS evidence excluded. The ruling will not be appealed through federal courts as the decision was made under the New York constitution and as the panel stated, only applies to New York. ... (read more)

Plea Bargain (also called plea agreement, plea deal or copping a plea) is an agreement, in a criminal case, between the prosecutor and the defendant. The defendant is given the opportunity to plead guilty usually for a part of his charges with a recommendation of a lighter sentence. After many appeals, the lawsuit between the Federal Communications Commission (FCC) and Fox is somewhat over. In a 5-4 decision, the U.S. Supreme Court found in favor of the FCC, stating they have the right to fine broadcasters for broadcasting “fleeting expletives”. The old policy of allowing networks “a freebie” is now over. Apparently, before this ruling the FCC let these so-called fleeting expletives, or one-off cusses slide. 9. Severance Pay

Severance pay amounts vary depending on the length of employment before separation, contract stipulations, and on salary. The age and seniority of the terminated employee are definite factors as well when determining how much severance is owed.
