The Punjab and Haryana high court has suspended the sentence of Deveshwar Dayal, former general manager, Haryana Roadways, Karnal, who had been undergoing rigorous imprisonment of five years for allegedly printing bogus receipt and challan books and was charged with embezzlement between 1999 and 2001. Dayal was sentenced to undergo rigorous imprisonment by the special judge, Karnal, under various sections of the IPC and Prevention of Corruption Act on October 28 last year and was slapped a fine of Rs 45,000. It was alleged that Dayal, while posted in Karnal from October 21, 1999, to May 21, 2001, got printed a bogus receipt book and a challan book. It was also alleged that after challaning the vehicles, he used to receive the composition fee from the vehicle owners and used to give bogus receipts. Thus the amount of the composition fee was being embezzled. Arguing for Dayal, advocates Jasjit Singh Bedi submitted before the Bench headed by justice KC Puri that conviction was based on secondary evidence and secondary evidence was not admissible until primary evidence was produced in the court.
