No one can just neglect what a trademark can contribute to the reputation of a corporation or a company. A lot of people may underestimate the importance of a trademark, but in fact, it can greatly help a business entity to boost the marketability factor of their products. Having a trademark allows a corporation or a company to embark their identity in the market; exhibiting it all over the television and newspaper ads, billboards, flyers, posters and other advertisement paraphernalia. All existing trademark laws state that a mark should not be confusingly similar with other existing marks. The number one characteristic of a trademark is uniqueness. This will make the products distinguishable from the other ones. It is much easier to penetrate the tough competition in the market if your products are instantly recognizable because of their trademark. Before venturing to a new business, you should first be aware of the trademark registration procedures in the state that you would like to invest. The trademark legislation in each state has only slight differences with each other. All trademark applications should be filed to the Secretary of State. Almost all the states require applicants to provide the basic information regarding the business like the owner’s name, the business name and address, the description of the goods to be covered by the mark and the specimen of the mark. The products or services should be classified accordingly. In Texas and Tennessee, they follow the International Classification of Goods and Services with 45 classes while Missouri embraces a different classification consisting of 42 classes. In Tennessee, you can include products of multiple classes in a single application. It is a different story in Missouri because you have to file an application for every single class. Usually, if the application is successfully filed, the next stage is for the trademark to be examined. We mentioned earlier that uniqueness should be intrinsic to trademarks. They will test if the submitted mark is all original and not confusingly similar to other trademarks in the registry. Upon passing the examination, the trademark is normally published on a journal for public viewing. Objection from third parties may be entertained if they think that the validation of the trademark will have conflict with the protection that they are entitled to. If the mark is clear of any objection, then the applicant will be given a certificate of registration. The trademark’s validity period usually lasts for 5 years.
