It will make your goods recognizable to the public. Use your creativity and innovativeness to craft a unique mark that will provide individuality to your goods. Register the mark in the prescribed office for it to be protected by the law. It is your right as a business owner to protect your intellectual property. To register your mark in Texas, you should file an application in the office of the secretary of state. The application should state the necessary details needed for the application, say, the name and address of the individual or corporation seeking for registration, the names and descriptions of the goods the mark will apply to and the class of the mark. The class refers to the classification of products and services based on the guideline adopted by a certain territory. As for Texas, it complies with the International Classification of Goods and Services with 45 classes, which is also embraced by the rest of the United States. Upon the filing of application, you will pay for the prescribed fee of the service. The mark will then undergo examination to check if the mark is acceptable for registration. If the mark is found to violate the guidelines stated in the trademark law, you will be given a chance to amend the component of the application that makes it not eligible for registration. In some cases, the secretary of state recommends the claimant to submit a new application. If the mark to be registered is confusingly similar to one of the existing applications, the priority will be given to the one that is filed first. If your application is rejected because of this, you may render an action to cancel the other application if you have the superior right to it. In case of denial application, you can file a motion to reconsider the application of your mark. The secretary of state will then reexamine the eligibility of your mark. If you mark is in compliance with the pointers stated by the trademark law, then it will be awarded with a certificate of registration that will be valid for the next five years.
