Driving while impaired is never a good idea. If you get pulled over while intoxicated behind the wheel, the consequences could be severe. From hiring a DWI attorney in Pasadena to understanding the laws in your area, here are a few things that you need to know. - It’s important to understand the basics of driving while intoxicated. You can get a DWI while driving an ATV, boat, golf cart, motorcycle, and bicycle. In order for the charge to qualify as a DWI, your blood alcohol content, or BAC, must be above a 0.08 percent or higher at the time of arrest. Even if your driving wasn’t erratic and you were pulled over for a different reason, you can still be charged if your BAC is above the legal limit.
- You may see an increase in your insurance rates. Once you’ve been charged with a DWI, your auto insurance company will probably classify you as “high-risk”. This means that you can expect an increase in your monthly premium. Some insurance carriers may even refuse to carry you as a client. In some cases, your life insurance premium may also go up.
- Alcohol isn’t the only thing that can impair your driving. Many people associate the term “driving while intoxicated” with alcohol. While many drivers are arrested because of their impairment due to alcohol, illicit drugs, and prescription medications can also cause erratic driving. If you’ve consumed any sort of drug or alcohol that could affect your driving, don’t get behind the wheel.
- Most DWIs aren’t felonies. Normally, DWI charges are considered misdemeanors. There are exceptions to this rule, though. In the event that someone is seriously injured or killed due to your impaired driving, your charges may be increased to felonies. If this isn’t your first DWI charge, the likelihood of your charge being classified as a felony also increases.
- Prepare to lose your driver’s license. If you are convicted of your DWI charge, you will most likely lose your driver’s license. In some cases, you’ll be issued a temporary license that expires on the date of your hearing. If you don’t attend your hearing, then your license will be suspended indefinitely. In some situations, you may be required to attend a driving course in order to have your license reinstated.
- You need to hire an attorney. After your arrest, you’ll be arraigned. During this time, your charges are formally read, and you’re given the opportunity to plead guilty or not guilty. This is as far as you want to go on your own. Hiring an attorney is the best way to minimize the damage done by your arrest. An attorney is able to strategize and come up with the best way to plead your case. In some cases, they may be able to strike a plea bargain.
When you’ve been charged with a DWI, it’s time to get serious. Hire a DWI attorney in Pasadena to handle your case, and educate yourself on the laws in your area. It’s the best way to resolve your case and ensure that your future isn’t destroyed due to your poor choice.
