Today US government offers a wide number of chances for foreigners to permanently migrate to US. Family based immigration is more common which allows the foreigners to enter US with the help of a close relative in US who will act as a sponsor to the foreigner. In other words, a family based Green Card is distributed based on the point that you have a relative who is a citizen or a lawful permanent resident of the US. There are eligibility criteria for both the sponsor and the beneficiary to obtain the green card under this category. Who Can Get A Family Based Green Card? The following are eligible to obtain the green card • Spouses, unmarried children under the age of 21, and parents of U.S. citizen petitioners 21 or older who are considered as immediate relative of a U.S. citizen • Unmarried sons or daughters over the age of 21, married children of any age, and brothers and sisters of U.S. citizen petitioners 21 or older who are family member of a U.S. citizen fitting into a preference category, • Spouses and unmarried children who fall under the family member of a green card holder category, • Battered spouse or child (VAWA), a K nonimmigrant, a person born to a foreign diplomat in the United States, a V nonimmigrant or a widow(er) of a U.S. Citizen fall under a special category, Who Is Eligible To Sponsor? One who can sponsor green card to the immediate relative should • Be a lawful permanent resident or a citizen of the U.S. and be able to present documentation showing your status • Demonstrate that you can support your relative at 125% over the required poverty line How To Get A Green Card? • USCIS will have to approve Form I-130, Petition for Alien Relative. The Form I-130 is filed by the sponsoring relative and must be accompanied by proof of the relationship to the requesting relative. • If an immigrant visa number is instantly available to the foreign national, it is then possible to apply to have one of the immigrant visa numbers assigned. • If the foreign national is already in the United States, he or she may apply to adjust status to that of a lawful permanent resident after a visa number becomes available. If the foreign national is outside the United States when an immigrant visa number becomes available, he or she must then go to the U.S. Embassy or Consular office with jurisdiction over the area in which the foreign national resides to complete your processing. Depending on whether you are considered an "immediate relative" or a "preference immigrant" governs the waiting times for your ability to file for your green card. Immediate Relatives include: • Spouses of U.S. citizens • Minor unmarried children (under 21 years of age) of U.S. citizens • Parents of U.S. citizens who is at least 21 years of age; and • Spouses of deceased U.S. citizens Preference Immigrants Include: • First Preference - unmarried children of U.S. citizens (i.e., who are 21 years of age or older) • Second Preference - spouse or children of LPRs (2A), or unmarried children of LPRs (2B) • Third Preference - married sons or daughters of U.S. citizens • Fourth Preference - brothers or sisters of U.S. citizens 21 years of age or older Obtaining a green card is the first step on the path to filing citizenship application and hence do not delay in obtaining a green card.
