A Fall River man who used a forged cheque to pay for car repairshas been placed on house arrest for six months. John Mark Tillmann, 51, was sentenced this week in Dartmouthprovincial court on charges of fraud under $5,000 and forgery. The court was told that Tillmann defrauded MacKay's CarStar, anauto body shop in Upper Sackville, last Nov. 16. Tillmann told the company his name was John Danzig and presentedwhat appeared to be a certified cheque to cover $1,983 worth ofrepairs to his 20-year-old BMW. The next day, he faxed the shop tosay he wasn't pleased with the quality of the work and was going toput a stop payment on the cheque. One of the shop"s owners went to the CIBC branch in LowerSackville and discovered that the cheque wasn't valid. It was later learned that Tillmann had attended a bank branch and,while left alone at the counter, used a teller's stamp to make ablank promotional cheque look like it had been certified. Tillmann pleaded guilty to the charges in March. He has more than15 criminal convictions since 1988 and was sentenced to two yearsin prison in 2009 for extorting, assaulting and threatening aformer girlfriend. Crown attorney Scott Morrison asked for a six-month conditionalsentence with house arrest and 20 hours of community service, whiledefence lawyer Patricia Hutton requested probation. Judge Alanna Murphy said the Crown recommendation was"abundantly fair." Tillmann will be confined to his home on Guildwood Drive unlesshe"s at regularly scheduled employment, dealing with medicalor legal matters, taking part in counselling or performingcommunity service. He can leave his residence for four hours a weekto tend to personal needs. The judge prohibited Tillmann from consuming alcohol or drugs orgoing within 20 metres of MacKay"s CarStar. She also orderedhim to pay full restitution by Aug. 15. Tillmann"s actions involved a significant amount ofpremeditation, Murphy said. "It"s not a crime of opportunity or something that wasimpulsively done, but something that was done with forethought andback work," she said. In his presentence report, Tillmann acknowledged that what he didwas wrong but said he needed to get his car fixed and didn"thave any money. "What that means is you put your needs above the needs of thecompany that was going to service your car, and you didn"tcare if they got their money or not," the judge said. "Your need trumped their need, and it doesn"t provideanything close to an excuse." An ex-girlfriend – not the one Tillman was convicted ofextorting – attended the sentencing hearing, carrying a babythat she said is his.
