A couple in Bakersfield, Calif. won a landmark lawsuit against a transvaginal mesh device manufacturer, becoming the first victims in the nation to win a verdict over the controversial products. A Kern County Superior Courthouse jury awarded Christine Scott and her husband $5.5 million in damages because of the injuries caused by a Bard’s Avaulta Plus transvaginal implant. The devices are used to treat pelvic organ prolapse (POP) and urinary tract issues. Christine was awarded $5 million in damages, while her husband was awarded $500,000 for loss of consortium. The Securities and Exchange Commission says that there are currently 650 pending lawsuits against transvaginal mesh manufacturers like Johnson and Johnson, Boston Scientific Corp and C R Bard Inc. “I was like ‘Thank you, God.’ We can finally get the word out to women,” Christine told television station KGET-TV 17. The Scotts were battling the manufacturer in court for four years. Randy Hood McGowan, Hood & Felder, LLC
