A Pictou lawyer is suing Bell Aliant and Yellow Pages Group Co. fornegligence after her phone directory listing was allegedly changedwithout her consent. Dena Bryan and her law practice, J. Dena Bryan Inc., filed thelawsuit in Nova Scotia Supreme Court on Thursday. In a statement of claim, Bryan says her practice was listed asBryan, J. Dena in the New Glasgow and Pictou phone books for 14years. Bryan has practised law in Pictou County for 22 years and openedher own office in 1994. She alleges the listing changed after heroffice moved in September 2008 and she obtained a new phone number. The Pictou lawyer alleges the listing was changed to J D Bryan Lawin the Pictou directory. The practice didn"t appear at all inthe New Glasgow phone book, court documents say. When contacted Friday, Bryan said potential clients also hadproblems finding her number through directory assistance after themove. "As a result of the numerous errors and omissions by BellAliant and Yellow Pages, there was effectively no public listing ofmy office telephone number," she said in an email. "I"m sure you can appreciate the importance of having apublicly listed phone number for any business, but especially a lawoffice where clients must call to book appointments." The Pictou lawyer said she didn"t become aware of the changesuntil April 2011 because she didn"t receive new phone booksafter the move. She said she became aware of the issue when someonetold her they couldn"t find her number in the phone book. "I suffered economic loss during the 30 months because thenumber of new clients decreased, as did my income," she saidin the email. Bryan said she no longer practises real estate law because of theloss of business. The practice is now restricted to family law, shesaid. In court documents, Bryan says Bell Aliant and Yellow Pages werenegligent because they unilaterally changed the listing, dropped itfrom the New Glasgow directory and didn"t notify her. According to the statement of claim, Bryan is seeking unspecifiedspecial damages and aggravated damages, plus interest, costs andany other relief. The amount being sought is more than $100,000, court documentsindicate. None of the allegations have been proven in court.
