A federal jury awarded $7.27 million as damages to a Denver man for a rare lung disease caused by the chemicals in microwave popcorn. The "popcorn lung" case Wayne Watson,59, developed bronchiolitis 'obliterans' often referred to as "popcorn lung" after eating two bags of microwave popcorn every day for about 10 years. He was diagnosed with the lung condition in 2007 at the National Jewish Hospital in Denver. The disease may lead to lung transplants and more complications. Following respiratory problems, Ken sued the manufacturer and the store that sold popcorn. He won a lawsuit against manufacturing company Gilster-Mary Lee Corp. and The Kroger Co. owned grocery stores, Wednesday. Both will jointly pay a hefty $ 7 million to the plaintiff. Ken McClain, Watson attorney stated his client was diagnosed with the disease due to consistent exposure to chemicals used in the artificial flavouring of the butter popcorns. “He ate two to three bags a day, one in the morning, one in the evening, and sometimes, if his wife was there, he would pop one in for her,” McClain argued. Ken further argued that his client frequently got exposed to the chemicals whenever he opened the bag after popping them in microwave. Wayne usually consumed Kroger Movie Theater Butter and First Choice Extra Butter brands, both bieng made at the Jasper (Mo.) Popcorn Co. plant. Interestingly, the disease was also detected in the employees working at the Gilster-Mary Lee Corp plant, many of who sued the company and won the verdicts. Wayne Watson is the first consumer to win an award against Gilster-Mary Lee Corp. Ken after the verdict said, “What happened here was an avoidable tragedy. Gilster-Mary Lee knew its own employees in the quality control room were getting sick from popping corn.
