Already barred from practicing medicine in Connecticut, a formerGreenwich doctor who was classified as a sex offender after policecaught him in a sex sting can no longer practice medicine in NewYork, according to the New York State Department of Health . In a determination dated March 28, the state board for professionalmedical conduct in New York stated that Clifford A. Berken , 59, "is no longer entitled to the trust which is required ofthose who practice the medical profession" because of his criminalconduct. "Although he expressed remorse for his actions, he has only begunthe rehabilitative process," the document states. Prior to his arrest, Berken had a private practice, located at 500 W. Putnam Ave., and was affiliated with Greenwich Hospital . He pleaded guilty in February 2010 to a charge of attempting todisseminate indecent material to a minor after he engaged insexually explicit online conversations with an undercover officerposing as a teenage boy. Berken was arrested when he attempted tomeet the boy in White Plains, N.Y., and was instead confronted bypolice. He was sentenced to five years of probation. The Connecticut sex offender registry lists a Farmington address asBerken's residence. Public records indicate that Berken has acurrent residence in Stamford. Mary Alice Moore Leonhardt, Berken's Connecticut attorney, said shebelieves the New York decision suggests the board misinterpretedexpert testimony in the hearing and "misapprehended many of theunderlying facts in this case." "We were very disappointed the New York board decided to revoke his license," she said. "I expect that Dr.Berken and his New York counsel will be filing an appeal." Amy T. Kulb, Berken's New York attorney, could not immediately bereached for comment Wednesday. In an email to Greenwich Time Tuesday, William Gerrish , a spokesman for the Connecticut Department of Public Health , said Berken does not have a license to practice in Connecticut. "His license expired on December 31, 2010, and became void on March31, 2010," Gerrish wrote. Berken applied to have his license reinstated, but at the time ofthe application Berken's case wasn't yet resolved in New York, andthe application was denied, Gerrish wrote. Connecticut general statutes prohibit the Health Department from issuing a license to anyone against whom professionaldisciplinary action is pending or who is the subject of anunresolved complaint with the licensing authority in anotherjurisdiction, Gerrish wrote. State law also authorizes the department to deny a license to anyapplicant who is subject to pending disciplinary action orunresolved complaint before the licensing authority in anotherjurisdiction, he wrote.
