With no end in sight to the continuing tussle between state-runCola India Limited (CIL) and the power producers over the fuelsupply issues, the Power Ministry has petitioned the PrimeMinister's Office (PMO) to intervene and settle the issuepertaining to signing of new Fuel Supply Agreements (FSAs) and somecontroversial clauses in it. The issues continues to hang fire despite the PrimeMinister's Principal Secretary, Pulok Chatterjee having helda number of meetings to sort out the mess arising out of thefailure of CIL to supply adequate coal to power plants and theleading power producers petitioning the government seeking a stablecoal supply regime in place. The issue is stuck for the last two months as majority of the powerproducers have reservations about certain clauses, including thoserelated to penalty, in the revised Fuel Supply Agreement (FSA) putforward by Coal India (CIL). The ball is back in the PMOs court totake a decision on the FSAs to be signed with leading powerproducers. With the issue showing no signs of being sorted out, Power MinisterSushil Kumar Shinde has written to the PMO seeking intervention onthe issue. Mr. Shinde's communication to PMO comes after ahectic round of discussions the Central Electricity Authority (CEA)held with various power generators on May 9 to gather their viewson the problems faced in signing of FSAs. Officials in the PowerMinistry said that Mr. Shinde has urged the PMO to direct the CoalMinistry and CIL to sign FSAs within a month based on the 2009format. Last month, the government had issued a directive asking CIL to inkFSAs with an assurance for minimum 80 per cent fuel supply to powerplants. However, power producers have said various conditions inthe new FSA such as on penalty and bringing ordinary businessdifficulties under force majeure are not acceptable. Another areaof concern is that for new units at the same plant, the developerhas to ink the revised FSA while coal supply would be based onearlier pact for old units. The Coal Ministry has already issued a directive to coal companiesto supply fuel to power plants commissioned till March 31, 2012 aswell as those to be commissioned during 2012-13 through theMemorandum of Understanding (MoU) route till the FSA issues areresolved.
