The ENS Visa refers to the Employer Nomination Scheme Visa that grants Australian permanent residence status to overseas workers sponsored by Australian employers. This scheme was designed to improve Australia's global competitiveness by satisfying shortages in the local skilled labour market, and ‘keep’ the best proven skilled workers. If you want to sponsor your overseas workers so that they can start working in Australia through the Australian skilled migration scheme, you will need to take the ENS Eligibility Assessment. The ENS (Subclass 186) visa has 3 streams: 1. Temporary Residence Transition Stream - for qualifying 457 visa holders who have completed 2 years on the 457 in the nominated occupation, and with the ENS nominating employer. 2. Direct Entry Stream - for a range of applicants including non-qualifying 457 visa holders, who have a skills assessment in the nominating occupation and 3 years (post qualification) work experience. 3. Agreement stream - where a nominating business holds a Labour Agreement. Basic Requirements for the Australian ENS Visa The application process goes through 2 important stages: 1. Employer Nomination Australian employers should meet requirements to nominate the approved position. This can be done by: a) Demonstrating that they are lawfully and actively operating in Australia b) Being committed to the training of existing employees - meet the "Training Benchmarks" c) Demonstrate a genuine need for the employee d) The position must meet market salary and minimum (TSMIT) salary levels The position that has to be nominated or filled should also meet some requirements. For instance, it must be a full time position for a minimum of 2 years. It should also be included into the gazetted list with approved ENS occupations. (CSOL) 2. Visa Application Once the nomination gets approved, you need to lodge the visa application within 6 months. This should be done at the same DIAC Business Centre as the nomination even when the nominee isn't in Australia. They can be lodged together. Qualifications for prospective applicants include: 1. Aged 49 years or younger 2. Meet the prescribed criteria for the English language 3. Hold the necessary qualifications, skills and/or experience for the position nominated. Some applicants will be exempted from the English language, skills and age criteria depending on their past work experience, salary and occupation. To meet the Employer nomination visa criteria, all applicants should satisfy certain character and health requirements. In case the applicants don't have sponsors, if eligible, they can still lodge the Expression of Interest. This is done through the DIAC Skill Select database. Prospective state/territory governments and employers can then view the applicant details from this database and offer ENS/RSMS sponsored jobs. Entitlements for the Australian Employer Nomination Scheme Visa Successful employer nomination visa applicants will become permanent residents in Australia. As such, they will be entitled to study, live and work in the country permanently. Other benefits include the opportunity to apply for citizenship, various social security benefits (after waiting periods) and government-subsidised healthcare. Benefits of the ENS Visa The ENS visa has a great advantage for people who meet the requirements for work experience, English language, qualifications, occupation and age. For instance, you can generally obtain this visa faster compared to independent skills visa, as they have a higher processing priority. This means that successful applicants may find themselves a permanent resident in Australia within a period of 6 months or so. Skilled Migration Recruitment Health and Character Requirements Australia has the strictest requirements for visa applications which have to be met before the ENS Visa can be granted. If you wish to migrate into this country, you will be required to: 1. Undergo medical exams and a chest x- ray. This should be performed by Australian health services in the country and Australian panel of doctors outside the country 2.
