The K3 Spouse Visa is non-immigrant visa which gives legal permission to the spouse of a U.S. citizen to come into the U.S. and stay while he or she completes the immigration process to obtain their Green card. Since it is a non-immigrant visa, the spouse can only enter America once, while holding this visa. As soon as the spouse enters the U.S., he or she must apply for the permanent residency status via the adjustment of status process. The foreign spouse is not permitted to work in the country until he or she gets the work authorization approved after filing the adjustment of status. They will need to complete the correct forms for this authorization at the time of completing their Adjustment of status. The biggest advantage of this visa was that it allows the foreign spouse to quickly enter the U.S. Over the past several years, the processing procedure has changed and the visa is no longer very fast, it now takes between 8-11 months to process. This also means that due to the higher expenses with this visa it is not as advantageous as the CR1 visa. A cost effective spouse visa is the CR1 visa. It is an immigrant visa so the processing takes a little longer (9-11 months), but the foreign spouse will receive their Green card upon entry at the border! The cost is also cheaper than the K3 visa. The various requirements which are needed to be fulfilled before applying for this visa are: • The applicant must be the legally married to the U.S. citizen. Some of the supporting documents which will be required are: • Passport, citizenship (if applicable) • An original Marriage certificate is a must. • If previously married than the spouse must have the proof of termination of his or her previous marriage in the form of a death or divorce certificate. • NOC (No Objection Certificate) from the local police (varies on embassy). • A valid passport • Birth Certificate • Medical Examination Certificate The K3 visa is still a viable option for many. To begin the K3 visa process the American spouse needs to complete Form I-130 and Form I-129F with the USCIS. After this, USCIS will notify the U.S. spouse with the notice of action receipt. Once the application is approved, USCIS will forward the petition to the National Visa Center (NVC) where it is updated and prepared to be shipped to the United States Consulate/Embassy where the applicant has applied for this spouse. The processing time for this visa varies so it does not have fixed time duration.
