In ascertaining this; HR has to do a tightrope walk, because probing beyond how much the employee wants to reveal can amount to intrusion of privacy and can lead to potential lawsuits. On the other hand, not taking down details can deprive the employee of benefits that would have accrued to her if the process was more open. This is why employers need to implement a process that allows them to meet obligations to involved parties and to carry out these conversations confidently. Several rules and regulations state that employers should not make accommodation conversations any more difficult than warranted. So, it is best for the organization’s HR to document conversations related to ADA declaration and coverage. This session will give participants a proper understanding of how to traverse this delicate area.
