457 subclass Australianvisais a most common used program in Australia. This program is for Australian employers or for employers in foreign country employers to sponsor skilled workers out of Australia to work temporarily in Australia. The full name of this subclass is temporary business (long stay). On 24th November 2012, the title was changed to temporary work (skilled) (subclass 457). Applications for this subclass are processed by the Department of Immigration and Citizenship. 457 subclass Australian visa allows eligible and skilledemployers to address skills shortages that cannot filled from the Australian local market. The holder of temporary work (skilled) (subclass 457) may be working for duration between 3 months and 4 months and can bring any eligible family member, who has unrestricted study and work rights in Australia. Holder this subclass have no limits on the number of times he/she travels in and out of Australia. Under this 457 subclass employer must be approved as an eligible employer by Australian Government. How to apply- to sponsor an overseas employee under subclass 457, three stages are required which are as follows - Sponsorship- the employer applies as a standard business sponsor for approval. This is required to nominate an occupation for this subclass.
- Nomination- an occupation is nominated by an employer for existing or prospective for subclass 457
- Visa application- the person nominated to work in nominated occupation applies for this subclass.
This is the final step for obtaining subclass 457. Visa applicant (employees) Overseas skilled workers and any dependents must apply for and be granted visa to remain or travel in Australia.It is important to note that temporary work (skilled) (subclass 457) application cannot be processed further, if applicant’s application is not supported by an approved employer along with approved nomination. Requirements are as follows- - A minimum demonstrated English language ability
- An adequate health insurance is necessary and must be arranged for period of stay in Australia.
- A genuine intention must be shown to perform nominated occupation
- Standard visa requirements such as health and character checks along with a declaration concerning Australian laws and values must be met.
Restriction Conditions under this visa state that the employer is confined to the nominated occupation, and any period of unemployment cannot exceed twenty eight days. Holder of this visa is allowed and eligible for borrowings form Australian bank. Since many holder of this visa are in Australia for long term employment and also many end up becoming permanent resident.
