The digital forensics is basically a terminology which is employed when the digital artefacts are taken from the computer system in a forensically sound manner. This includes the spreadsheets, documents, pictures, emails, PDA or any other device with a storage capability. The operation of the digital forensic can be done even if the previous data was erased. The data can be completely tracked down in order to gain the information regarding its creation or installation. However, if we talk about E discovery, it is simply a process of gathering data. The data which is gathered is readily available and is found in a storage device such as computer, iPhone, iPad or server. The volume of data managed in the both processes is also one of the significant differences between two. In discovery approach the data can be narrowed down significantly whereas in forensic approach the data is checked by ‘bit by bit’ image. The ediscovery is only concerned with providing a responsive data to the reviewer in a cost effective and timely manner. However, it is not concerned with the analysis of the data and the wrong allocation of data space. The ediscovery employs sophisticated software solutions in order to provide their clients a review platform for end results. The software solutions which are used in this process are the duplication, hit counts, keyword researches etc. Comparatively, Forensic analysis of data is handled by an individual having impeccable credentials. The biggest difference here is that the forensic expert need not only be qualified enough to follow the necessary procedures but should also be ready for being called for deposition in court. Since the forensic expert has to take a stand for his report therefore it is important that the expert should be highly qualified as well as skilled in this field. The analogy can be simplifies as taking as an example of a contractor and electrician where discovery can be considered as a contractor and forensics as an electrician. Ediscovery is a wide field of services which helps in getting the end user results. However, forensics are specialized service which is necessary in only particular instances and can only be done by a trained professional. Overall, we can say that an individual can easily confuse between these two. This is true especially in today’s scenario when most of the vendors market themselves under ediscovery umbrella.
