Public seating is any chair, bench, sofa, or stool that someone other than the person that works at a business uses to sit on. Public seating can be found outdoors, in parks, at bus stops, at theaters, in waiting rooms, and in front of buildings. There are a few requirements to public seating you must be aware of before you create an area for people to rest their legs. Public Seating Requirements: The chair or piece of furniture that you provide for people to sit on must be in good condition. Broken pieces of furniture provides too many chances of someone being injures. • The seat must be properly maintained so that it remains attractive and serviceable. • The seat should be made of materials that can be cleaned and sanitized to reduce the spread of germs and disease. • The item should be bolted or fastened to the ground in such a manner that it cannot be tipped over and cause injury to another person. • The item needs to have holes in the bottom to allow rain water to escape if it is going to be outside and not under a sheltered cover. • Each chair should have a maximum weight limit posted so people can judge whether or not to sit on the item. • Metal items should be galvanized so they do not rust and become harmful to the public. • Seats inside buildings should be cleaned daily to stop the spread of disease. • Seats with cloth covers should be cleaned every three months to kill bacteria growing in them. • Outdoor seating should be cleaned at least once every six months. If you are establishing seating that is going to be available to anyone other than your customers and employees you need to check with the city management to find out if you have to have a permit to create these areas. Many parks and cities will allow you to donate a bench in the name of your business for people to rest on. The city or the park authorities will usually do the maintenance and upkeep of these items after they are donated. A plaque is usually placed on the item saying who provided the respite. You will want to talk to your insurance carrier about seating areas that are going to be on your property. You will want to know the logistics of having these areas established and whether or not your insurance will cover any injuries to people while they are in them. Signs prohibiting smoking must be clearly placed in areas where seating is provided, but smoking is not allowed. When people who smoke are outside they feel it is their right to light a cigarette unless there is something telling them not to. If pets are likely to be brought into the area encourage owners to pick up their wastes. You will need to provide a waste receptacle for the trash to be placed in.
