The Injuries Board will assess your claim assuming the person you hold responsible, the ‘respondent’ consents to the Injuries Board assessing your claim. Your personal injuries claim will be assessed by the Injuries Board on the basis of the information you submit on the application form and by medical report of your treating doctor. They will also insist on having you medically reviewed by their own nominated doctor. The Injuries Board will then make an assessment of your claim based on all of this information. Both the Applicant (i.e. you) and the Respondent can either accept or reject the Assessment. As your solicitor, we will advise you on the adequacy or otherwise of your settlement. If both parties accept the Assessment then you will in due course receive a settlement cheque. You will have to pay your own legal costs however as it is rare that the Injuries Board will award you your legal costs. If either party rejects the Injuries Board Assessment then what is known as an ‘Authorisation’ will issue to your solicitor. This allows your solicitor to begin either Circuit Court or High Court legal proceedings for personal injuries. If your accident occurred here in Limerick legal proceedings would usually issue and be heard in due course in the High Court or the Circuit Court which sits in Limerick City. On the 1st of October, 2013, Patricia Byron, CEO of the Injuries Board, issued a press release (link is posted below) which shows that in the first half of 2013 there has been a 10% increase in the volume of personal injuries claims received by the Injuries Board.
