Why isn’t anyone telling you this? We are here to tell you the truth about K3 visa and how it is no longer the fastest spouse visa, but rather a very expensive option. If you are married to a U.S. citizen, you can be eligible for the K3 spouse visa or CR1 spouse visa, both of which are spouse visas. However, these two visas are not identical. We’ve highlighted information about each of these visas below, but CR1 Visa is the best option for spouse visa. About the K3 Visa - To be eligible for K3 Spouse Visa, you must be married to a U.S. citizen (not to a permanent resident).
- Technically, K3 Visa is a non-immigrant visa. This means, you will need to apply for the Adjustment of Status once you are living in the U.S. to receive your Green Card (permanent residency).
- If your marriage terminates before you’ve received the Green Card, your K3 Visa will expire within 30 days.
- K3 Visa is a multiple entry visa, and you are free to travel abroad. However, if it expires while you are abroad then you will need to apply for a re-entry permit.
- Once you are in the U.S. on K3 Visa, you may apply for a work permit.
- As you need to apply for the K3 Visa, and then for Adjustment Status, overall the K3 Visa costs more than the CR1 Visa because you need to apply for this Adjustment of Status to obtain your Green card.
About CR1 Visa - CR1 Visa is an immigrant visa, which means you will receive the permanent residency when you are issue CR1 visa, and receive the Green Card upon arrival in the U.S.
- CR1 Visa takes about a month longer than the K1 Visa, but this is due to issuing of Green Card, which requires further verifications.
- You don’t need to apply for a separate work permit. If you are on a CR1 Visa, you are eligible to work in the U.S.
