During a criminal case, it is normally the state and not the victim that usually brings charges against the defendant. The state has a representative who prosecutes the defendant in a trial by jury in the name of a prosecutor or district attorney. However, there are a number of tasks that the prosecutor needs to complete so that they can fulfill the goal of a conviction because it is the state that obligated with the burden of proof. A criminal law attorney may actually start off as an assistant district attorney specializing in misdemeanor cases. Finally, when they reach the level of district attorney the criminal law attorney can decide how criminal cases are prosecuted and can start managing other lawyers. Many prosecutors are employed by the court system, state or county governments while others work for the federal court systems.
During the first step of a criminal trial, the prosecutor will weigh the quality and quantity of evidence before they decide whether they can go ahead and file the charges. If it becomes apparent that there isn’t strong evidence, the district attorney will make a deal with the criminal defense attorney. A prosecuting criminal law attorney is required to do a lot of legal research, prepare legal documents, and talk to the witnesses as well as the victim so that they can evaluate all the evidence relating to the case. The objective here is to ensure that they present a compelling and realistic explanation of why they believe the defendant is guilty. The prosecution must present logical arguments that will also appeal to the jury; they must also anticipate the counter-arguments of the criminal defense attorney and counter their doubts.
If a defendant doesn’t have the financial capability to hire a criminal defense attorney, there are services of public defenders who are government appointed criminal law attorneys. Public defenders normally work at federal and local state levels but only in criminal cases; a private criminal defense attorney is hired and paid by the defendant and they are not employed by the government. However, you need to realize that the public defender and the criminal defense attorney both do similar tasks in preparing for trial and negotiating on behalf of their client. A criminal defense attorney will often try to negotiate with the police or the prosecutors to try and lower the charges or even the punishment levels. When the case goes to trial, it is the defense attorney who advises their client how to enter a plea and the defense strategies they are going to use in court. The criminal defense attorney prepares and reviews all the court documents, examines the evidence found during discovery and does any required legal research in addition to training their client on how to deal with cross-examination.
