Once your benefits have been approved, it's important to avoid situations that could cause you to lose you benefits. Your social security attorney in Boise can help you understand these factors as well as fight for the reinstatement of your benefits. Returning to Work The level of disability is directly related to the inability to work because of physical or medical impairments. Therefore, going back to work can compromise your benefits. The Social Security Administration does allow for one trial work period (TWP) of nine months. This exception is meant to be experimental to see if you can work. Going over nine months will cause your benefits to stop. The SSA also sets earning limits at $735 a month and assets at $2,000. Free housing, food, and household goods also count against those limits. Medical Improvements A “medical improvement” is essentially your level of recovery from the condition that warranted disability. The SSA can determine your recovery status through a Continuing Disability Review (CDR). The administration must notify you, usually via mail, that they are reviewing your disability status. You may be asked to provide a record of recent medical treatments and your daily activities. If the agency feels you have recovered enough to return to work, benefits will be stopped. This decision can be appealed through the SSDI appeals process. Retirement Age Reaching the age of retirement will also cause your disability benefits to cease. They are automatically converted into standard social security benefits. Disabled Child Turning 18 When a disabled child who qualified for benefits turns 18, payments will stop unless the child can meet the qualification for disability as an adult. Living Situation A change in your living situation can affect your benefits. If you are admitted to a nursing home, ASL, or a hospital for more than 90 days, benefits will cease. Keep this in mind if you want to avoid losing your benefits and contact a social security attorney in Boise if you need to file an appeal.
