The backbone of the military legal system is the uniform code of military. Military law is a law that governs members of the armed forces. The law is normally applied to civilian but in special circumstances, personnel who return from a tour of duty must return to civilian life where the transition seems to be difficult. Application of this law reflects recognition of such people to different duties. The military justice system is a primary law enforcement tool of the armed forces. Courts-martial, the united state court of appeals and courts of criminal appeals are three tiers of military courts. Uniform code of military establishes rules and regulations that govern people in the military. It is normally applied both in armed services and abroad. It also implements laws of war which applies during armed conflict. In addition, uniform code of military established court-martial which all trials involving service people take place. The different issues covered by the uniform code of military are types of courts-martial, rules that govern jurisdiction, legal investigations discharge and trial process. There are three forms of tribunals which include special court-martial, summary court-martial, and general martial court. The national defense by the Congress duty is carried out through military service. Military enlistments comprise of six service obligations divided between active and reserve duty. The enlisted obey lawful orders and serve in combat as required. Enlistment creates both a contractual obligation and change in recruit’s legal status. Conscription is the draft the route which people inaugurated into military service. The last method of entry to the military is by appointment of an officer. Officers are fixed to a rank within a specific branch of the service. The law of war refers to the international law that is accepted justification of the nation to take military action. It is designed to limit war and to restrict the started war from causing unnecessary destruction. This body comprises of treaty agreements and rules publicize d by the United Nations. There are three principles and they include military necessity, proportionality, and distinction. Military personnel their entire life and are discharged without any complications. An Honorable discharge is issued in case member’s record reflect acceptable military conduct and duty performance. Bad conduct is punitive discharges and can only be issued after court martial. Military separation may be accomplished through administrative proceedings. Discharge review board and board of correction of the military are the two administrative bodies that review discharges.
