They will help in the custody and assets and also end the marriage in a more amicable manner. There are two possible ways of mediation and they are: - Court-based mediation
- Private family mediation (Out of court mediation)
Court Based Mediation: Child Focused Resolution Centre Mediation sessions If the couple has the child aged below 21 years, then they must attend the Child Focused Resolution Centre (CFRC) mediations. The couples will also receive the notices to attend the mediation sessions. If you had appointed a lawyer, then he should be accompanied with you so that they can advise on various matters related to your divorce in Singapore. These sessions will be conducted before filing divorce papers and before the first divorce hearing. The duration will vary according to the complexity of the case. These sessions are settled in more than 3 sessions or less. The family counsellors and trained judge-mediators will be the mediators. Mediation ordered by the family court Under the Family Justice Act, the court is empowered to direct certain cases to the mediation or counselling services provided by the courts. Such cases would have commenced proceedings and is likely to be in the midst of hearings. Mostly, the judges with their experience will look for amicable solution for your case and also complete it quickly. In case, they order for mediation, then the trained judge-mediators and family counsellors. Similar to mediation at the CFRC, should both parties manage to reach an agreement, the judge will record it and it will be bonding on both of them. If there are emotional issues and complex legal issues then the judge may consider for co-mediation. During co-mediation sessions, a judge-mediator and family counsellor will help the couple to solve their issues amicably. Private/Out-of-Court Mediation This is not similar to court-based mediation which is compulsory or directed, the private mediation sessions are voluntary and applicants should sign in the mediation schemes. With private mediation, the couples have the advantage rather than the court-based mediation. Before filing the court papers, the couple might undergo the family law mediation. This might end in the possible way for the couples. But you will have to pay for the private mediation sessions. There are several ways of mediation available and they are Family Mediation Scheme and Collaborative Family Practice. In Family Mediation Scheme, the mediator acts as a neutral third party, will assist couples undergoing divorce to resolve the relevant issues involved. Collaborative Family Practice is an alternative for Family Mediation Scheme. Though it is similar to Family Mediation Scheme, the CFP is by SMC. CFP is done before the hearing of the divorce case begin and must be agreed by both the parties. Some of the disputes that can be resolved through CFP are: - A party who is incapacitated in some way
- There is a history of violence or substance abuse
- There are serious concerns about dishonesty
Under CFP, specially-trained lawyers are assigned to help couples to negotiate the issues involved in divorce.
