Philippine Daily Inquirer reported that state run Power SectorAssets and Liabilities Management Corporation is seeking bids tosupply and deliver PHP 488 million worth of coal that will fuel the146 MW Naga power complex in Cebu. According to company documents, PSALM needs to secure 84,000 tonnesof local blended coal for the Naga power complex. Interestedbidders have until May 8th 2012 to submit their offers to PSALM.PSALM has conducted several auctions for contracts to supply coalfor the Naga power complex, but has yet to announce the results. In April 2012, PSALM sought offers for the supply and delivery of104,000 tonnes of steaming coal worth PHP 722 million, following afailed bidding in March 2012. In February 2012, PSALM also conducted a bidding for 55,000 tonnesof imported steaming coal and 85,000 tonnes of local blending coalworth a combined PHP 868 million. PSALM is mandated by law to procure the fuel requirements of allgovernment owned power facilities and contracted capacities, whileawaiting their privatization as in the case of the Naga powercomplex. PSALM has yet to privatize the contracted capacity of the Nagafacilities, after it postponed the bidding for the independentpower producer administrator, originally scheduled for October2011. PSALM had decided to grant the request of the Joint CongressionalPower Commission to defer the bidding as it wanted to furtherreview the right to top the highest bid granted to SPC PowerCorporation in 2009 through a Land Lease Agreement executed byPSALM, National Power Corporation and SPC. Under the agreement, SPC has the right to top by 5% the highest bidprice offered by interested parties for the IPPA contract. The landlease agreement, which contains the questioned provision, stemmedfrom SPC's acquisition of the 55 MW Naga land based gas turbinepower plant in 2009. The agreement was provided then as an incentive to the winningbidder of the Naga LBGT, giving it the right to top the highest bidon the sale or lease of the properties within the vicinity, oncondition that it pays a premium of 5%.
