NEW DELHI: The case involving imposition of Rs 630 crore penalty on realty major DLF by fair trade regulator CCI has been adjourned till February 7 by COMPAT (Competition Appellate Tribunal ) in response to the appeal made by DLF. In its appeal DLF sought time to file objections against the new supplementary order passed by CCI. The tribunal while listing the matter for hearing on February 7 announced that although the agreement between DLF and Gurgaon based Belaire project apartment buyers has been modified by the Competition Commission of India (CCI), the agreements for other projects are yet to be amended. The COMPAT bench headed by Chairman Justice V S Sirpurkar was intimidated by DLF that objections against the CCI proposed modified agreement will be filed by the company before the tribunal. Pursuing a directive from COMPAT regarding specification of extent and manner of pact amendment, a 104-page supplementary order was passed last week by CCI that modified the Belaire project buyers’ agreement. The agreement that was amended on the orders of CCI has done away with the abusive and unfair conditions of the original but has honored the interest of both parties. Based on the complaints by flat buyer associations of Park Palace and Belaire projects alleging certain anomalies against DLF, CCI had passed the original order on August 12, 2011.
