Child custody is never an easy issue to go through. The very matter is upsetting, but it's a necessary evil when it comes to ensuring that children get proper care. The issue of child custody happens whether the parents are married or not. The court recognizes paternity through DNA testing as opposed to legal status of the parents. What this means is that a custody issue between two unmarried parents is treated the same as if the parents were divorcing. There is no special distinction between the two marital statuses in the eyes of the court. Different types of custody mean different types of arrangements for the parents to work around. Custody is typically granted in the best interests of the child as opposed to the parents. One parent may desperately want to care for the children as much as possible, but if that parent can not provide a stable home, the judge is less likely to grant the wish. The parent that can prove there is a stable living environment available is the one that has the stronger chance of getting the desired custody. A lawyer helps prove this situation by gathering the right evidence and presenting it to the court. Sometimes, it so happens that one parent is very unfit to take care of the children, but has full custody. In this situation, going back in front of the family judge is warranted. This is where having a lawyer is beneficial to the parent who is seeking to remove the children from the home. It takes persuasive arguments along with proof of the poor living conditions and much more, but a lawyer can make the removal of the children from the negative environment more likely to happen than not.
