Generally, those with Federal Firearm Licenses (FFL) are required to use NICS in order to determine if it is legal to sell a firearm to the potential buyer. NICS determines if the buyer is allowed to purchase a firearm under the Gun Control Act of 1968, which is linked to the Interstate Identification Index and National Crime Information Center. The National Instant Criminal Background Check System is applicable to sales of firearms from federally licensed dealers. Private sellers, on the other hand, are allowed to sell without a background check unless required by the law of the state. These regulations are also applicable at gun shows, where no additional requirements are obliged from private sellers and no special lenience is granted to the licensed ones. In behalf of the buyer of the firearm, the NICS is accessed by an FFL, either by phone or computer. When contacted by phone, the FFL will speak with directly the NICS Examiner/FBI or by proxy through a call center agent. When using a computer, the FFL representative will submit the information of the buyer through the E-check system, minimizing the overhead involved in managing identification of multiple individuals. By law, the FFL must receive the response from the National Instant Criminal Background Check System within 3 days or the sale process can still continue even though the FFL seller has no business doing so. If the sale is complete after 3 days but the buyer has received the firearm already, the firearm must be retrieved.
