If your crime is a minor traffic violation, tress passing or juvenile crime, then your criminal record can be sealed. If your criminal record should have been sealed but was not, then there are 3 simple steps to get it done. - Get a copy of your criminal record (rap sheet). This is available online for $55 fee on the website of “Division of Criminal Justice Services (DCJS)” at: http://www.criminaljustice.ny.gov/. This is fingerprint based information and is only available to you and your attorney. Also, you can get this from New York Unified Court System’s site at: http://www.nycourts.gov/apps/chrs/. Here it is not fingerprint based search, so it may not be accurate.
- Take a copy of the record to the court where you were convicted and ask the clerk of the court for a disposition slip which is official. Make sure that it has a seal on it. You have to pay $10.00 - $15.00 fee for this.
- You have to send this slip to Division of Criminal Justice Services (DCJS) along with letter explaining the reasons why you want to have your case sealed.
Your record will be sealed within 12 weeks. You have to contact DCJS for confirmation as they will not notify you automatically.
