DUI vs. DWI - What Is The Difference?

There is no big difference between getting a DUI vs. DWI citation. The citation is the ticket that is issued for someone who is driving under the influence of drugs or alcohol. Some states used the term DWI which means Driving While Intoxicated for a period of time until they wanted a broader term that also included those who were driving under the influence of drugs. Thus, DUI, or driving under the influence, was born. This is the difference between dui and dwi. Some states still use the DWI laws when it comes to those who may be under the influence of drugs while they are driving a car or a truck.

When thinking about DUI vs. DWI, you may wonder which is worse. Any time that you get into a car and drive when you are impaired because of alcohol or drugs is a crime. In fact, this is considered a felony, even for a first time offender. Those who want to know the difference between DUI and DWI might wonder if certain aspects of this law apply to them. Most states have both laws on the books although some have just broadened the DUI laws to also include those who may be under the influence of a drug that impairs them while operating a motor vehicle. It is important to note that no matter why you are impaired, it is a felony to drive in this condition. This includes the use of prescription pills that can make a person drowsy and not be able to function properly on the road.

A felony conviction is the last thing that any person wants. Without a defense, chances are that the judge will throw the book at even a first time offender. Because this is a felony charge, there is a potential of jail time. Most of those who get caught for a DUI or DWI will get an attorney who will attempt to work on a defense for them. In most cases, the case never gets to trial and the defense attorney will work out a plea bargain with the state prosecutor. Both DUI and DWI offenses are state charges and the punishment varies from state to state. However, the cost for the defense coupled with the fines will, at the very least, cost the person who is charged with this criminal act thousands of dollars.

Those who take drugs or drink and drive are taking a serious risk, no matter what they are taking. Chances are that this behavior will catch up with them sooner or later. The vast majority of those who are caught with a DUI have a history of driving drunk. It is not unusual for people to get more than one DUI or DWI when they drink; however, many states have jail time awaiting those who are caught for a second or third time. In most cases, those who are caught the first time will lose their privilege to drive (which can mean their job) and also have to pay quite a bit of money in fines as well as for an attorney to defend them. If you drink or take drugs, call a taxi before getting in your car to drive. It is far cheaper than the consequences you will face if you get caught with a DUI or DWI.

The difference between DUI and DWI is inconsequential. Both are felonies for being under the influence of drugs or alcohol while driving. Those who want to learn more about DUI vs. DWI can go to DWI DUI.
