False and misleading representations is found in chapter two of the Australian consumer law. The chapter has general protection which creates the standard of business conduct in the business including the general ban of false and misleading representation in trade or commerce. Section 18 of this chapter prohibits any person in trade or commerce from engaging in false or misleading representations. The circumstances of each case figure whether the representation is misleading or false. A statement misleading one group of consumers may not mislead the other group. A representation can be misleading or false even if it is true. Testimonials are statements from the previous consumer about a particular goods and services. False and misleading representations in ACL apply to advertising of goods and services, packaging and any information provided by the staff about particular goods and services. The representations also apply to the statements made on the social Medias about goods and services. The Australian consumer law normally prohibits the business from making false or misleading representation in regards to the standard, quality, and value of goods and services, warranty, and condition of goods and services, the price of goods and services and availability of repair facilities and spare parts. Examples of the business behavior found misleading are like a real estate agent provides misleading information about the property and a jewelry store advertising the price of a certain commodity been lower than usual to attention purposes. Fine print and qualifications, comparative advertising, bait advertising and environmental claims are examples of false or misleading advertising. False or misleading representation is an offense and carries criminal penalties. The civil remedies may include the injunctions, damages, disqualification of orders and compensation.
