The case law is commonly used with the term common law. It refers to precedents and the authority that was set by the earlier court rulings, the judicial and legal findings and rulings. The constitutional law, the regulatory law, and the statutory law are the main categories of law. Sometimes it becomes hard to deal with statutory laws that are created by the law bodies and to give the direction and guidance of the society. The stare decisis is a doctrine of the precedent. It simply means to stand by the decided matters and not to disturb the settled matters. This simply means that the court will rule according to the previously established rulings. It is difficult to get a ruling opposing any precedent and it normally involves the appellate courts. The legislative statutes can be enacted to overrule the precedent. Related Articles -
