From 6th April 2010 approximately 11 million employees in Britain have been given the right to request time off work to train. This new legislation applies to all companies who employ over 250 staff and requires employers to consider all requests for training and respond to the employee within a set timescale. The aim for for employers to agree appropriate training with staff, which is relevant to their job, workplace or business. The training may lead to qualifications or may be unaccredited but will help develop relevant skills. Time spent training does not have to be paid time and employers only have to consider one request per employee in any 12 month period. To apply for a request to training the employee must have continuously worked for their employer for at least 26 weeks. The employer can turn down requests, where there is a good business reason to do so, including where there is a belief that the training will not help business performance. However, employers should ensure that they apply judgement criteria fairly and consistently. The new right closely follows the model used for agreeing requests under the flexible working arrangements and the procedure does include a right of appeal for the employee.
