A roadway in Wilmington had to be closed for several hours recently when an accident between a Cadillac and bicycle resulted in injury to the bicyclist. According to Wilmington police, Lamont Worthan, 22, pulled his bicycle out right in front of traffic. An oncoming Cadillac was unable to stop in time and struck the bicycle, according to the accident report. The driver of the gold Cadillac, Freddie Taylor, was startled by Worthan’s sudden presence. Taylor claimed that he did not have time to react and could not stop before hitting the bicycle and rider. Police were apparently in agreement with Taylor’s account of the incident. He was not cited in the accident. Worthan, however, who suffered a facial injury from hitting the windshield of the car, was cited for unsafe movement. He is expected to recover from the injury. The incident is indicative of the numerous unexpected events that can occur on Wilmington’s roadways and the necessity of remaining ever attentive while operating a motor vehicle. In this case, it is not likely that any sort of personal injury case exists since the victim who was injured would appear to be the one at fault for the accident. However, in many accidents, the circumstances are reversed and the victim suffers an injury that is in no way the victim’s fault. When a victim is not to blame for an injury, both common sense and the law say that the responsible party bears financial responsibility for the injury in most cases. Sometimes the injured victim receives suitable compensation without issue. However, it is often the case that an injury victim is offered a settlement that is far less than what the injury will end up costing monetarily, and certainly far less than what it will end up costing in terms of emotional stress and undue anxiety for both the victim and the victim’s family. In such situations, it is usually necessary to retain an injury lawyer in order to receive just compensation. Sometimes someone with an injury is hesitant to contact a lawyer because they feel as though the hassle of a court case would be too overwhelming and would just add additional stress to an already difficult situation. However, in many personal injury cases, your lawyer will be able to obtain a settlement without ever having to take your case to court.
