attorney Mark Murphy sought a middle-term sentence. He said McGeeabused a position of trust to take advantage of a particularlyvulnerable girl. The incident had a tremendous impact on the teen,who was forced to move and suffered assault, ridicule and a loss offriends. "It's heaping abuse on a young girl who already faces considerablechallenges," Murphy said. The prosecutor also disputed McGee's assertion that the incidentwas an honest mistake that he would have to answer for.
Murphycited an incident in 1997 where McGee allegedly touched a16-year-old girl at a New Mexico radio station. Authorities theredidn't file charges due to insufficient evidence. Murphy said he was disappointed that the pre-sentencing reportdidn't consider the earlier case. He also pointed to McGee's comments to media. He said it wasselfish for McGee to talk about the impact only to himself and hisfamily.
Defense attorney Grady Davis said it was more appropriate toconsider McGee's comments to the Probation Department and to adoctor, who evaluated him. He said McGee didn't deny his actionsand surrendered himself to police the night after the incident. Davis concurred that McGee's actions were horrible. "This is totally unacceptable and heinous behavior," he said.
However, he indicated five years of probation coupled with jailtime and sex offender classes would be a better solution thansending McGee to state prison for effectively a year. Howell noted several key issues with the case, including McGee'sharm to the victim and the age disparity between McGee and theteen. He also noted the defendant's confession and expression ofremorse, in addition to the doctor's evaluation that McGee wasn'tpredisposed to reoffending. In handing down his sentence, the judge said McGee needs to bepunished, but didn't initially see the case as a prison case. Terms of probation included the jail time and the sex offenderclasses, which will take about three years to complete.
Howellordered that McGee stay away from the girl and all children under18. McGee must also register as a sex offender for the rest of hislife.
