Federal Sentencing Guidelines - Federal Guidelines applicable to criminal defendants were promulgated by a Federal Sentencing Commission and passed as law by the U.S. Congress in 1986 under the Anti-Drug Abuse Act (The 1986 Act). These guidelines gave sentencing judges a range of sentences to apply in each type of criminal case. In the case of cocaine sentences Congress enacted a 100-1 ratio for convictions of crack verses powder. the Act's five-year mandatory minimum applies to any defendant accountable for 5 grams of crack or 500 grams of powder, and its ten-year mandatory minimum applies to any defendant accountable for 50 grams of crack or 5,000 grams of powder. Congress apparently found (in 1986) the newly marketed product, crack cocaine to be much more dangerous that powder.
