How is special damages defined? Damages that are granted to a person or business in a legal procedure are referred to as special damages. Since the student will be spending out of his/her own pocket for travelling to the new college, the expenses may be classified as special damages. Hence, he/she may be able to sue the community college for special damages if he/she can prove that there has been a rise in his/her pocket expenses due to travelling to the new college. The student may file a motion to adjust the complaint against the community college and specify the financial expenses that he/she has to suffer due to the travel to the new college when filing the lawsuit. When a person files a claim against another person for having to spend out of his/her own pocket because of any issue, it may be referred to as a special damages claim.
