With the Supreme Court giving its nod to the Election Commission toreopen the probe against former Maharashtra Chief Minister AshokChavan relating to the non-filing of proper accounts of hiselection expenditure, the Commission has fixed May 17 as the freshdate for hearing. Sources said the hearing would begin at 4 p.m. and the Commissionwould probably decide to have a daily hearing as Chief ElectionCommissioner S.Y. Quraishi is demitting office on June 10. Notices have been issued to Mr.
Chavan and the complainants. The issue was first exposed by The Hindu wherein campaign advertisements in support of Mr. Chavan, prior toOctober 13, 2009, Maharashtra Assembly election, were published inHindi and Marathi newspapers by camouflaging them as news items. An independent candidate and BJP representatives complained to theCommission that Mr.
Chavan had not included the money spent on suchadvertisements in the election expenditure accounts submitted byhim and had thus violated the EC rules. Mr. Chavan won the poll from Bhokar Assembly segment. On November 3, 2011, a three-judge Bench of Justices Altamas Kabir,S.S. Nijjar and J.
Chelameswar of the Supreme Court had temporarilyhalted the Commission from probing Mr. Chavan's poll accounton his appeal against a Delhi High Court order, which had allowedthe probe. Subsequently, on May 2 this year, a Bench of Justices Altamas Kabirand J. Chelameshwar of the Supreme Court ordered that theCommission could go ahead with the probe. It ruled that thefindings should not be made public and instead be kept in a sealedcover.
The EC had begun proceedings against Mr. Chavan on April 2, 2011 onthe complaints, which alleged that he had shown to the Commission apoll expenditure of merely Rs. 11,000 despite paying money tovarious newspapers for favourable coverage of his electioncampaign. The complainants, who sought disqualification of Mr.
Chavan forfailing to give proper election expenditure account, referred toChapter III and Section 10A of the Representation of the PeopleAct, 1951, which deal with "Disqualification for failure tolodge account of election expenses." According to it, "if the Election Commission is satisfiedthat a person has failed to lodge an account of election expenseswithin the time and in the manner required by or under this Act,and has no good reason or justification for the failure, the ECshall, by an order published in the Official Gazette, declare himdisqualified. Any such person shall be disqualified for three yearsfrom the date of the order." Mr. Chavan challenged the EC probe against him in the Delhi HighCourt saying that the Commission had no power to probe his account,but the Court said the poll panel was well within its right toprobe it. The former Chief Minister had argued that there was no mention ofseeking of votes in his favour in any of the advertisementsconcerned.
The election expenditure was submitted to the authorityconcerned in time and prima facie this was approved by the DistrictElection Officer (Returning Officer). He had no role to play in thenews stories, Mr. Chavan had claimed.
