In most real estate transactions, an agent or broker can answer your questions. However, when it comes to more complicated issues surrounding a short sale or foreclosure, it is in your best interest to consult a real estate attorney in Austin. Most real estate agents are not licensed to practice law and are inexperienced when it comes to complicated issues that will be costly to fix later on. If you find yourself needing a real estate attorney, it is important to remember that not all attorneys are equally qualified to handle your case. If you need a real estate attorney, here are some questions to ask to ensure a potential attorney is qualified. How Many Cases Like Mine Have You Handled? Every real estate situation is unique; however, a potential attorney may have had similar cases to yours previously. The more cases that he or she has had similar to yours, the greater advantage you have of achieving a positive outcome. By having an attorney familiar with many cases like yours, he or she will be better able to foresee problems and attack them head on. To increase your likelihood of hiring an attorney who is equipped to handle your situation, ask friends or family for a referral. You might find that someone close to you has had successful work done on a real estate matter and can give you a referral. You can also contact an attorney you trust and ask him or her for the name of a real estate attorney. How Long Have You Been Practicing Real Estate Law? It is beneficial to find out how long a potential attorney has been practicing real estate law. This will give you an idea of how much real-life experience he or she has. Some attorneys who are new in the field can be great for simple matters such as helping you understand a purchase agreement. However, when it comes to bigger issues that make a difference, it is best to find an attorney with about 9-14 years experience. A skilled attorney won't mind answering questions about his or her experience. You can ask whether the attorney graduated from an accredited law school, and if that school was in or out of state. If the potential attorney attended an out-of-state law school, it is a good idea to find out how much experience he or she has with your current state's laws concerning your real estate issue. These laws can vary from state to state, so you want an attorney who is up to speed on the issues. What are Your Fees? It can be stressful to deal with real estate questions. The last thing you want is to be unpleasantly surprised later by unexpected attorney fees. Most real estate attorneys work on an hourly basis and will charge you for every hour they spend working on your case. If you don't anticipate your case taking a lot of time and you just need some help with paperwork, then an attorney might agree to a flat-rate fee. Ask about the attorney's payment requirements up front. Will You be Working on My Case? Some well-established attorneys have junior attorneys on their team. In some cases, he or she will hand off the work to one of these junior attorneys, even though you initially assumed that he or she would be handling the case. If you are particular about wanting a certain attorney, make sure you ask whether it will be him or her handling your case. If you are in the market for hiring a real estate attorney in Austin, then contact a professional near you.
