The Dos and Don’ts Following a Motorcycle Accident

Law
If you are a motorcyclist, it is crucial that you know what to do and what not to do if you are ever involved in an accident. One wrong move can mean the difference between receiving compensation and receiving nothing from your insurance company.

What to do

• Go to the emergency room – This is absolutely essential. Even if you think you are not injured, chances are good that the adrenaline pumping through your system is affecting your ability to feel pain or think clearly. Some injuries may not be immediately noticeable. Insurance companies are notorious for trying to deny claims made several days or weeks after an accident. Go to the ER and get checked out no matter if your injuries seem minor at the time. If someone offers medical attention, do not refuse it. Be sure to do exactly what your physician instructs you to do, and be sure to go to any follow-up exams.

• Document and photograph the scene - Write down everything about the accident that you can. Include names, addresses, license plate numbers, and any information about the others involved in the accident and witnesses. Get insurance information from all directly involved in the accident. Take photos of the scene as soon as possible. Someone is likely to have a cell phone camera that you can use if you do not. Have those photos sent to you. Make a note of weather conditions, road hazards, vehicle position, and any other information that might be applicable to the accident.

• Listen and observe – Make a note of anything the other people involved in the accident have to say. Any apologies, excuse-making, blaming or other verbal information may be very useful later on.

• Keep a detailed journal/scrapbook – Include all pertinent information about the accident and your injuries in the days, weeks and months following the accident. Include all medical bills, receipts, and other documentation. Describe your injuries and any pain you suffer during this time and how it affects your daily life and routine. Take photographs of your injuries. Detailed stories and photos go a long way in a court room.

What not to do

• Do not admit fault or talk about the accident to anyone – You will be questioned by the police, doctors, nurses, and others at the scene and afterward. Do not say anything to anyone that might be construed as an admission of guilt or neglect on your part. Avoid talking about anything but your injuries to medical personnel.

• Consult a motorcycle accident attorney – Motorcycle accidents are subject to specific laws, regulations, and insurance issues that other accidents are not. You will want an experienced motorcycle accident attorney on your side to ensure that you receive maximum compensation for damages and injuries.

If you or a loved one has been injured in a motorcycle accident, please call or e-mail our motorcycle accident attorney today for a free consultation in the New York area, including Brooklyn, the Bronx, Queens, Manhattan, Long Island, and New York City.
