Your Rights & Obligations – Temporary Partner Visa (Subclasses 309 or 820) If you are granted a temporary partner visa (Subclasses 309 or 820), you will be allowed to: 1. Remain in Australia until a decision is made on the permanent visa application (generally occurs two years after the grant of the temporary visa). There is no specific date expiry date for your temporary visa 2. Leave and re-enter Australia as long as the temporary visa is valid 3. Work, study and enrol with Medicare • Once you are granted a temporary partner visa, your sponsor and yourself must maintain your relationship and meet all applicable legal requirements when a decision is made on your permanent residency partner visa application • You are obligated to inform DIAC of any changes in your circumstances (Form 1022), a change of address (Form 929) or if your relationship ends Your Sponsor’s Obligations As part of completing and signing Form 40SP, your sponsor is signing an undertaking that he or she will meet the following obligations: 1. Responsible for all financial obligations which are owed to the Australian government which you may incur while in Australia 2. Provide you with reasonable accommodation and financial assistance while you are the holder of a temporary partner visa 3. Provide you with financial and other forms of support (e.g. childcare) that are required to allow you to attend any English classes that you need 4. Help you settle into Australia by providing information and advice, including help with finding a job 5.
