We hear it all the time, everywhere, on TV and on the radio, and especially during the day. The phrase no win no fee has now been around for over a decade and heavily promoted from the start. So how did the no win no fee concept start and what is the intention behind it? Before the no win no fee concept was born the government provided legal aid to anyone who had claimed for personal injury and couldn’t afford the legal fees. This arrangement put a strain on the government and a new system was sought to reduce the high costs of legal aid. The proposal of a no win no fee strategy was accepted in 1998 and since then there has been plenty of press and different opinions regarding this topic. Many law firms popped up overnight taking advantage of the no win no fee service, and indeed many law firms saw this as an excellent opportunity to make money quickly. Indeed, it opened up the possibility for the man in the street to take legal action against an opponent without risking much of a financial loss. This is a system that makes it fair for the people who have a genuine case and rightfully need to receive a no win no fee compensation for their injuries, and who also fall outside the brackets of very rich or poor enough to claim legal aid. It is always a good idea to sit down with your no win no fee solicitor and go through different scenarios of what might happen if you lose the case. The interpretation of the law and ways of practicing it may vary and you must be sure to get any guarantees in writing and ensure that you clearly understand the processes your case will go through.
