China will enforce preventive and remedial measures to preventextortion of confession by torture and collecting evidence throughillegal methods, a government action plan released on Monday said. The National Human Rights Action Plan of China (2012-2015)published by China's State Council Information Office (SCIO)pledges that no one will be forced to prove himself or herselfguilty. The action plan said all rights of the person are guaranteed by lawin lawsuits and law enforcement in China, and the people'sprocuratorates will pay greater heed to the self-defense ofcriminal suspects at the stage of approval for arrest. Procurators themselves should interrogate suspects when there areclues or evidences that prove the possibility of such seriousviolations of law as extortion of confession and collectingevidence through the use of force, the action plan said. If the criminal suspects request such an interrogation, theprocurators should do so as required, it said.
The action plan said China will improve relevant mechanisms tofacilitate the work of lawyers during criminal proceedings. When defense lawyers proffer written materials and evidencemaintaining that no crime has been committed, an arrest isunnecessary, or the suspect should not be detained, or there havebeen violations of law in the investigation, the procurators mustexamine them seriously. When necessary, procurators may consultlawyers in person, the plan said. The procurators should state clearly in the arrest warrant whetherthey are going to accept the lawyer's opinions and evidences andtheir reasons for doing so, according to the plan.
The venues of law enforcement and case investigation by publicsecurity organs will be transformed according to defined standardsstep by step, and the Standards for Venues of Law Enforcement andCase Investigation of Public Security Organs will be implementedstrictly, the plan said. Case investigation areas must be separated physically from otherareas, and the function rooms of the case investigation areas willbe established in line with the procedures of case investigation,where permanent sound and video recording as well as videosurveillance systems will be installed for real-time monitoring andcontrol management over the whole course of law enforcement andinvestigation to prevent any violation of the legitimate rights andinterests of citizens, it said. The scope of application ofthe system of probationary suspension and community correctionaccording to law will be expanded, appropriately reducing theapplication of imprisonment and clearly defining the scope ofnon-imprisonment, the plan said. The state will improve the system of community-based correction,and enrich the contents of community-based correction, correctionby education and measures to aid convicts in financialdifficulties, it said.
