The police officer said he couldn't tell him. Guy then asked whowas with Kylee and her son Hunter and when he was told no one hewent to be with them. Guy said he rang his wife to tell her that there had been a tragedyand Scott had been killed, and "worse than that, he's beenmurdered". Guy said he also rang Ewen MacDonald to find out where he was. Hebelieved he was still on the side of the road where he had seen himlast and remembered telling him they could be there for a while andthat he should go home and be with his family. 'You'd better get out here' Earlier, MacDonald had rung Bryan Guy at home, the first signsomething was wrong. Guy told the court: "Ewen was very distressed, when he rang me. Hewas almost incoherent, he said something along the lines that'something's happened to Scott.' "I remember him saying the words 'his face' and then he said 'you'dbetter get out here.'" Shot gun Bryan Guy identified a shotgun in Crown evidence as his and said itwas usually kept in a safe with a combination and key lock, withboth needed to unlock it. He said Scott knew the combination, as did Callum, and he was notsure if he had told Ewen too or if one of the boys had told him. He said the shotgun had not been locked away because he had beenusing it to scare birds of the farm silage. On the morning of July 8 he put it away straight away. He saidMacDonald sometimes kept his rifle in his hot water cupboard and hehad told him he had better make sure it was locked away too. Defence counsel Greg King asked Guy whether he had told MacDonaldabout the combination or where to find the key for the safe wherethe shotgun was usually locked up. Guy said he wasn't sure if hehad or hadn't. Although it wasn't locked away, Guy said there was nothing to makehim think the shotgun had been moved from where he put it in itshiding place. Asked by King if he accepted lying to police about the location ofthe shotgun on July 8, Guy said "yes" and that he regretted it. 'My neighbour has had his bloody throat cut' A neighbour of Scott Guy, David Berry, found him lying in a pool ofblood. Berry today read to the court a recorded transcript from his 111call to police. From the 111 transcript, Berry told the court: "My neighbour hashad his bloody throat cut. He's dead. I think he's got his throatcut and he's lying cold. "I was just going to work and I see the lights on and Scott waslying in front of the driveway with his throat cut, he's dead Ithink." Berry told police there were "no weapons" at the scene, but hethought it was "probably a knife by the looks of it". When asked if he could perform CPR Berry said Guy was "past it,he's dead". Watery eyes In an exchange with King, Berry said that when MacDonald arrived atthe murder scene he had water streaming out of his eyes and lookedvery upset. Berry said he had thought the murder was mistaken identity and hewas the intended target because of an incident in his past. Berry also told the court that the night before Guy's body wasdiscovered an unsavoury stranger, smelling of alcohol andcigarettes, had knocked on his front door looking for Scott Guy.But Berry was afraid to tell him where Guy lived because he seemedso unpleasant. "I thought he was a little bit funny so I didn't really give himany information," Berry said. The defence says there is no doubt that Guy was murdered but policehave the wrong man. 'He was shot' While in the area of the cordon Berry said he heard someone say "hewas shot" but he does not remember who said it. Photographs presented to the court today show Guy's body was foundlying in a star-fish position with significant blood over his face. King presented the photo exhibits to Berry. Under cross examination, King probed Berry to recall on thatmorning that it was not MacDonald who made the comment 'he wasshot' it was a female voice which King said matches his statementhe made to police which he read "I think it was a close friend ofKylee's". Crown prosecutor Ben Vanderkolk told the court yesterday thatMacDonald had corrected Berry when he said his throat had been cut,saying Guy had been shot, even though no one had mentioned that Guyhad been shot by that time.
